Disputes initiated by a CAT Reporter with respect to CAT fees charged to such CAT Reporter, shall be addressed by the Fee Review Subcommittee or the Operating Committee, as applicable, in accordance with the Fee Dispute Resolution Rules set forth in the Participants’s CAT Compliance Rules. Additional materials regarding the fee dispute resolution process are available on the CAT Fees section of the CAT website (www.catnmsplan.com).
A CAT Reporter that disputes CAT fees charged to such CAT Reporter and that desires to have an opportunity to be heard with respect to such disputed CAT fees shall file a written application (“Fee Dispute Resolution Application”) with CAT LLC within 15 business days after being notified of such disputed CAT fees. The Fee Dispute Resolution Application is available here https://www.catnmsplan.com/sites/default/files/2024-10/10.28.2024-Fee-Dispute-Resolution-Application.pdf and is posted on the CAT Fees section of the CAT website. CAT Reporters are considered to have been notified of CAT fees on the day that email notifications that invoices are available on the CAT Reporter Portal are sent. CAT Reporters are required to send the Fee Dispute Resolution Application to the FINRA CAT Helpdesk at [email protected].
A CAT Reporter may request that the Operating Committee review a decision of the Fee Review Subcommittee by submitting within 15 business days after issuance of the decision the “Petition for Operating Committee Review of Fee Review Hearing Panel Decision.” The Petition for Operating Committee Review of Fee Review Hearing Panel Decision is available here https://www.catnmsplan.com/sites/default/files/2024-10/10.28.2024-Petition-for-Operating-Committee-Review-of-Fee-Review-Hearing-Panel-Decision.pdf and is posted on the CAT Fees section of the CAT website. CAT Reporters are required to send the Petition for Operating Committee Review of Fee Review Hearing Panel Decision to the FINRA CAT Helpdesk at [email protected].
For the purposes of the fee dispute resolution procedures, the term “business day” shall mean a day, based on U.S. Eastern Time, other than a Saturday, Sunday, New Year’s Day, Martin Luther King Jr. Day, Presidents’ Day, Good Friday, Memorial Day, Juneteenth National Independence Day, Independence Day, Labor Day, Thanksgiving Day and Christmas Day, and any other day designated as a holiday by the Operating Committee.
